Terms of Service

1. Acceptance of Terms
By accessing or using the AxenExpress platform, website, mobile applications, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our Services.
These Terms apply to all users, including individuals, sole traders, companies, and organisations. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Services
AxenExpress provides a technology platform that enables users to obtain quotes for, book, and manage international and domestic shipments using a network of carrier partners. Our services include express delivery, air freight, ocean freight, road freight, customs brokerage, and returns management.
We act as a logistics intermediary. The physical transportation of goods is performed by our carrier partners, who operate under their own terms and conditions. By booking a shipment through AxenExpress, you also agree to the terms and conditions of the relevant carrier.
3. Account Registration and Security
To access most features of our platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account at security@axenexpress.com.
You may not share your account with others or create multiple accounts for the purpose of circumventing usage limits or platform policies.
4. Prohibited Items and Restricted Shipping
The following items are strictly prohibited on the AxenExpress platform:
- Firearms, ammunition, and weapons of any kind
- Explosives, flammable materials, and hazardous chemicals (without proper certification and advance approval)
- Controlled substances, narcotics, and illegal drugs
- Counterfeit goods, pirated materials, and items infringing intellectual property rights
- Live animals, plants, and perishables (without prior arrangement and appropriate permits)
- Human remains, body parts, and biological specimens (without appropriate authorisation)
- Currency, bearer bonds, and negotiable instruments exceeding carrier limits
- Items subject to international sanctions or export controls
You are solely responsible for ensuring your shipments comply with all applicable laws and regulations in the origin and destination countries. AxenExpress reserves the right to refuse, intercept, or return any shipment suspected of containing prohibited items.
5. Rates, Payment, and Billing
Shipping rates are calculated at the time of booking based on declared weight, dimensions, service type, and origin/destination zones. The chargeable weight is the greater of actual weight and volumetric weight (length x width x height in cm, divided by 5,000).
If the carrier determines that the actual weight or dimensions differ from those declared, you authorise us to charge or refund the difference to your original payment method. Deliberate mis-declaration of shipment details is grounds for immediate account suspension.
Payment is due at the time of booking unless you are an Enterprise customer with approved credit terms. All prices are exclusive of applicable taxes unless stated otherwise.
6. Shipping and Delivery
Delivery time estimates provided at booking are indicative only and are not guaranteed unless you have selected a guaranteed delivery service. Delays may occur due to customs inspections, adverse weather, force majeure events, or circumstances beyond our control.
Force majeure events including natural disasters, pandemics, war, strikes, governmental actions, and network outages relieve AxenExpress and its carrier partners of liability for delivery delays or failures.
You are responsible for ensuring the recipient's address is accurate and complete. Failed deliveries resulting from an incorrect address may incur return fees.
7. Liability Limitations
To the maximum extent permitted by applicable law, AxenExpress's total liability to you for any claim arising from or relating to these Terms or the Services shall not exceed the greater of: (a) the amount paid for the specific shipment giving rise to the claim, or (b) USD 100.
We are not liable for loss of profits, loss of business, indirect, incidental, consequential, or punitive damages, even if advised of the possibility of such damages.
For shipments covered by our shipping insurance add-on, liability is limited to the declared insurance value. Insurance must be purchased at the time of booking.
8. Claims and Insurance
Claims for lost, damaged, or delayed shipments must be submitted through your portal within 14 days of the scheduled delivery date for loss claims, and within 7 days of delivery for damage claims. Supporting documentation including photos of damage, the original packing list, and proof of value may be required.
Optional shipping insurance is available at checkout. Insured shipments are covered up to the declared value. Claims on insured shipments are typically resolved within 10 business days of receiving all required documentation.
9. Cancellations and Refunds
Shipments may be cancelled before collection for a full refund. Once a shipment has been collected by a carrier, cancellation may not be possible and you may be charged for the full shipment cost plus any return fees.
Refunds for eligible cancellations are processed within 5 to 10 business days to the original payment method. Wallet credits are applied instantly.
10. Intellectual Property
The AxenExpress name, logo, platform, software, and all related content are the intellectual property of AxenExpress International Ltd and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
11. Termination
You may close your account at any time by contacting support or through your account settings. We will retain shipment records for the statutory period required by applicable law.
AxenExpress reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, non-payment, or conduct that we believe may expose us or our users to legal liability. We will provide notice where reasonably practicable.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
